Access to the SMART System or any SMART application that requires user login is governed by the Master Application Service Provider Agreement (“MASPA”) and the General Terms & Conditions (“GT&C”) between SMART and the applicable Customer, and by the Acceptable Use Policy (“AUP”) applicable to Authorized Users. These Terms do not apply to any authenticated portion of the SMART System. For clarity, a “Customer” is the entity or individual that has executed a MASPA or an Order with SMART (typically a school, district, or educational institution), and an “Authorized User” is an individual whom the Customer has permitted to access the SMART System.

1. Website Content and Ownership The Website and all content, materials, text, graphics, logos, and other elements are owned by SMART or its licensors and are protected by intellectual property laws. You may view the Website for personal, informational purposes only. You may not copy, modify, distribute, or create derivative works from Website content without SMART’s prior written permission. Content on the Website is provided for general informational purposes only and does not form part of the SMART System or any agreement between SMART and a Customer, even if the Website provides access or links to the SMART System.
