These Website Terms of Use (“Terms”) govern your access to and use of onlinesmart.net and any other public‑facing website operated by School Management and Record Tracking, Inc. (collectively, the “Website”). The Website is operated by School Management and Record Tracking, Inc. (“SMART,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
These Terms apply only to the public Website. Access to the SMART System or any SMART application that requires user login is governed by the Master Application Service Provider Agreement (“MASPA”) and the General Terms & Conditions (“GT&C”) between SMART and the applicable Customer, and by the Acceptable Use Policy (“AUP”) applicable to Authorized Users. These Terms do not apply to any authenticated portion of the SMART System.
For clarity, a “Customer” is the entity or individual that has executed a MASPA or an Order with SMART (typically a school, district, or educational institution), and an “Authorized User” is an individual whom the Customer has permitted to access the SMART System.
- Website Content and Ownership The Website and all content, materials, text, graphics, logos, and other elements are owned by SMART or its licensors and are protected by intellectual property laws. You may view the Website for personal, informational purposes only. You may not copy, modify, distribute, or create derivative works from Website content without SMART’s prior written permission. Content on the Website is provided for general informational purposes only and does not form part of the SMART System or any agreement between SMART and a Customer, even if the Website provides access or links to the SMART System.
- Prohibited Website Activities You may not attempt to gain unauthorized access to any non‑public areas of the Website or to any Website‑related account; interfere with or disrupt the Website; use automated tools such as bots, scrapers, or crawlers without permission; upload or transmit malware or harmful code; use the Website for unlawful, fraudulent, or abusive purposes; or attempt to harvest, extract, or collect data from the Website. SMART may suspend or block access to the Website for any violation of these Terms.
- Links to Third‑Party Sites The Website may contain links to third‑party websites. SMART is not responsible for the content, privacy practices, or security of those sites. Access them at your own risk.
- No Warranties The Website is provided “as is” without warranties of any kind. SMART does not guarantee that the Website will be available, uninterrupted, error‑free, or secure. SMART may modify, suspend, or discontinue any part of the Website at any time without notice.
- Limitation of Liability To the fullest extent permitted by law, SMART is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Website.

- Governing Law These Terms are governed by the laws of the State of Arizona. Any disputes must be brought in the state or federal courts located in Maricopa County, Arizona.
